For many Ukrainians who arrived in the United States after the Russian invasion of their country, two humanitarian protections have played a major role in their immigration status: Temporary Protected Status (TPS) and Uniting for Ukraine (U4U)*. * It is important to note that as of late January 2025, the United States paused processing of new travel authorizations and sponsorship approvals under the Uniting for Ukraine program as part of a broader review of humanitarian programs. Temporary Protected Status (TPS) is a humanitarian program that grants temporary immigration status and protection from removal through the Department of Homeland Security (DHS). TPS is only available to individuals from designated countries experiencing situations such as armed conflict, environmental disasters, or other dangerous temporary conditions.
The United States designated TPS for Ukraine in 2022 due to the ongoing armed conflict, and it is currently extended until October 19, 2026. To apply for TPS, individuals must file Form I-821, Application for Temporary Protected Status with U.S. Citizenship and Immigration Services.
Individuals may qualify for TPS for Ukraine if:
Uniting for Ukraine (U4U) is a humanitarian parole program initiated by the U.S. government. This initiative allows Ukrainian citizens and certain family members to enter the country with the support of a U.S.-based sponsor who can provide financial support. Form I-134, Online Request to be a Supporter and Declaration of Financial Support must be submitted to USCIS by the sponsor after a USCIS account is created.
Individuals who are eligible for sponsorship with Uniting for Ukraine (U4U) qualify if they meet the following conditions:
Aside from the eligibility requirements above, there are several key differences between TPS and U4U to consider.
TPS: Status is granted for a designated period set by DHS and may be extended if conditions in the country remain unsafe
U4U: Initial stay of two years, with potential for extension
TPS: Generally, travel outside the U.S. is restricted unless advance parole is obtained.
U4U: Travel outside the U.S. usually requires advance authorization or re-parole before returning to the U.S.
Both TPS and U4U provide eligibility for work permits, but the processes may differ based on an individual’s circumstances.
When comparing TPS and U4U, it is important to consider differences in stability, renewability, and eligibility.
In many circumstances, applying for TPS while you have U4U parole is a smart strategy, as they serve different purposes. Remember that you can apply for TPS even if you entered the U.S. through U4U; TPS does not cancel your U4U parole, and you can hold both protections simultaneously.
Applying for TPS can provide additional protection if your U4U expires soon, if you wish to apply for another legal status in case parole ends, and/or if you plan to stay in the U.S. for a period of time longer than two years. Many immigration lawyers recommend TPS as a backup protection for U4U parolees.
