The Visa Waiver Program (VWP) allows citizens of designated countries to travel to the U.S. for tourism or business purposes for a maximum stay of 90 days without a B-1 (business) or B-2 (tourism) visa. Travelers must have a valid passport and a return or onward ticket dated within the 90-day period.
The Electronic System for Travel Authorization (ESTA) is a security screening tool used to determine whether a traveler poses a security risk to the United States. Visitors must apply online via the ESTA website at least three days prior to departure. Once approved, it is generally valid for two years, or until the passport expires, whichever comes first.
It is important to note that even if you pass the initial ESTA screening, you can still be denied entry by a U.S. Customs and Border Protection (CBP) officer.
A broad change in ESTA vetting has not yet taken effect as of early 2026. The proposal is still under review—but, if passed, it could take effect at the end of 2026. At this time, CBP is reviewing public comments on the proposal, may make revisions, and will publish a final rule with an effective date.

Note that as of late 2025, CBP expanded routine biometric data collection at ports of entry that include facial scans and fingerprints for virtually all non-U.S. citizens. Travelers should monitor any changes to ESTA vetting, as once these changes are finalized, requirements will also change.
There are several reasons an ESTA may be denied. One of the most common reasons is a prior visa overstay. Even if it did not result in a formal three- or ten-year ban, an overstay can still render an individual ineligible for travel. If your previous stay exceeded your authorized period, even unintentionally, that history should be carefully reviewed before applying for ESTA.
Another common cause of denial is criminal behavior. Any arrest or conviction could result in a denial, even for a minor offense that occurred long ago. Failing to disclose a criminal history can create additional issues for a traveler, as it could be considered “misrepresentation.” Misrepresentation can lead to permanent inadmissibility. In these cases, it may be advisable to apply for a B-1 or B-2 visa rather than risk an ESTA denial.
Immigrant intent concerns can also lead to a denial. ESTA is designed strictly for temporary visits. If an applicant has a pending or approved immigrant petition, CBP may question whether they truly intend to depart within 90 days.
Travel history can also result in an ESTA denial. Travel to designated countries or dual nationality with specific countries may disqualify an applicant.
Even when an application through ESTA is approved, it does not guarantee entry into the country. CBP officers may refuse entry after evaluating admissibility. If questions arise, travelers may be referred to a secondary inspection for a more detailed review.
During secondary inspections, officers may examine your travel patterns, prior immigration records, employment, financial circumstances, or any other database red flags. Officers may also inspect electronic devices.

If refused entry, a traveler may be permitted to withdraw the application for admission and return home. However, there is a chance that you may be subject to expedited removal and immediately returned to your home country, which carries a five-year ban on reentering the United States. Such an outcome can complicate future applications for visitor or immigrant visas.
While future VWP approval is possible but unlikely, applying for a B-1 or B-2 visa is advisable.
Applying for a B-1 or B-2 visa should be considered for travelers with prior overstays, criminal records, immigrant petitions, or previous ESTA denials. An interview at a U.S. embassy or consulate, which is part of the B-1 and B-2 processes, allows applicants to explain complex circumstances to an officer rather than relying on automated ESTA screening.
While the visa process involves additional preparation, it can reduce the risk of sudden refusal at a port of entry and mitigate future issues with the U.S. immigration system.
